This website is the property of Soulduction, of which the head office is 167 rue de Bagnolet, 75020 Paris, France.
1. TERMS OF USE
MailMovement.com commits itself to respect the confidentiality of emails received from the users. For the realization of its online services, Soulduction may record certain personal informations. According to the article 34 from the French law “Informatique et Libertés” registered January 6, 1978, the user have the right to access, modify, rectify and remove the regarding informations.
This right can be done by sending an email to e-magazine@mailmovement.com or a mail at Soulduction -167 rue de Bagnolet – 75020 Paris, France.
2. COPYRIGHT
All the informations establishing the website MailMovement.com (articles, graphic designs, softwares, images, sounds, videos, names, brands, logos, data set, etc.) just as the website itself, depend on the French and international legislations on the copyright and the intellectual property.
These informations are the exclusive property of Soulduction.
Failing, the user commits its civil and/or penal responsibility to sanctions.
The user notably forbid itself to copy, to reproduce, to download, to diffuse, to transmit, to commercially exploit and/or to distribute in any way the services and the pages, the articles/texts, the pictures of the website MailMovement.com.
The set up of hypertext links from a third website to MailMovement.com needs the prior express agreement of Soulduction.
3. RESPONSABILITY
The user conceded Internet is an open network constituted by the interconnection to the international scale from the Informatics network. Networks can have adequacies of unequal transmissions and own applications policies, nobody can guarantee their right operation.
The user consents consequently to endure the risks of unavailability from the server.
The access online are open 7d/7, 24h/24, except the unexpectedly coming of an event constituting a force majeure, maintenance operations and necessary repairs for the good functioning of the services.
Soulduction can’t be held responsible for the case of online services interruption to execute repairs and maintenance or to fix technical difficulties.
Are also cases of force majeure, exonerating Soulduction from all responsibilities: a natural disaster, a strike, a fire, an attempt, a shortcoming of the electricity network, a blocking of conveyances or supplying of telecommunication networks, loss of connexion with the server due to public and private operators of which is depending MailMovement.com.
Taking into account the level of security set up, Soulduction won’t be held responsible for direct and indirect consequences from a system failure for the online service or a fraudulent access to the audit system, constitutive of a crime linked to the articles L323 and following the French penal code.
Soulduction can’t be held responsible for the material errors in the data processing that will have to be reported by the user since their discovery, to allow Mail Movement to correct it.
Soulduction can’t be held responsible for the precision or the inexactness of the contents provided by the users of the website MailMovement.com.
4. RULES OF CONTESTS
Soulduction organizes on its website MailMovement.com free contests and without purchase. These contests occur on an individual session for each.
These contests are open to everyone from everywhere in the world, excepted for the payroll which is the organizer of the contest and the payroll which is the provider of the gifts regarding the contest. It can only be one winner by home (same name, same address) and a unique participant by person.
The fees of the participation cannot be refund to the participants – as the fees of the Internet connection.
To participate to the contest, each participant will have to be subscribed first to the e-magazine through “mailmovement.com” and hence have entered its information (name, first name, birth date, address, city, code, email address, telephone) which will allow the organizers to contact the winner for the gain. Any incomplete or erroneous information will lead to a cancellation of the participation for the contest. The participant could have a possibility to answer to questions, and the winners will be selected to be drawn lots among the right answer or the first ones, depending on the participation rules.
Prizes are presented in the presentation of the contest. They will be sent to the address shipment specified by the participant, excepted the contrary mentions (for example, to pull out at a specified place depending on the days and hours signified in the email sent to the participants). In any ways, prizes could be exchanged for another objects, whatever their value, neither for money. If a participant wouldn’t want or couldn’t take possession of its prize, this one would have any right to any compensation. On a contest session, only one prize will be distributed by home (same name, same address). Winners will receive an email to indicate their gain into the 60 days following the date of the session enclosure. If this deadline should be extended, winners will be notified by email within the same period. In the case that the prizes should be pull out at a specified place; they will be available for a period of 30 days maximum following the receipt of the email signified to the winners. Any claim will have to be received within 3 months by post or email by notifying the information about the participant, the contest and the concerned session. Beyond that period, any claim won’t be accepted.
The organizers can’t be held responsible for a case of a service interruption caused by an Internet network incident or by a technical incident independent of their will, if the contest is partially or totally modified, postponed or removed. No compensation may be as such. In accordance with the French law “Informatique et Liberté” n°78-17 registered January 6, 1978 concerning Informatics, files and freedoms, we make the commitment to notify the persons who fill nominative data on our website regarding their rights, especially about their right of access and correction to this nominative data to the following email: e-magazine@mailmovement.com. Each member may at any time exercise that right at Soulduction/Mail Movement, 167 rue de Bagnolet, 75020 Paris, France; to protect your security and your privacy and to check your identification, you will have to join an ID with your request.
5. JURISDICTION - APPLICABLE LAW
Any protests that may arise in connection with the interpretation, the acceptance and enforcement of the Terms of Use will be an attempt at settlement, the parties undertake to seek.
Failing to succeed within one (1) month, the courts of Paris will be the only competent, even if a guarantee call or multiple defendants.
These Terms of Use are governed by French law.
